Overview: what data we process and on which legal basis<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">We process personal data only where the law allows it. Hosting, content delivery and server log files<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">rugyourlife.com is hosted by Aut O\u2019Mattic A8C Ireland Ltd. (WordPress.com, part of Automattic Inc., USA). rugyourlife.shop is hosted by SiteGround Spain S.L., Spain, on servers within the EU. Our domains, DNS and parts of our content delivery and security run through Cloudflare, Inc., USA.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When you visit our websites, the servers automatically record technical data that your browser transmits: IP address, date and time of access, the page requested, referrer URL, browser type and version, and operating system. We need this data to deliver the websites, to keep them stable and secure and to defend against attacks (Art. 6(1)(f) GDPR). Log files are deleted or anonymised after a short period, unless they are needed to investigate a specific security incident.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These providers process data on our behalf under data processing agreements (Art. 28 GDPR). Where data is transferred to the USA, the providers are certified under the EU-U.S. Data Privacy Framework or use the EU Standard Contractual Clauses.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">4. Cookies and consent management<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">We use the consent tool Complianz to ask for and store your consent to non-essential cookies and similar technologies. Your consent choices are stored in a cookie on your device. Analytics and marketing tools are only loaded once you have given your consent. You can change or withdraw your consent at any time via the \u201cManage consent\u201d link at the bottom of every page. Details of each cookie can be found in our Cookie Policy below.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">5. Contacting us, enquiries and bespoke commissions<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">When you contact us by email, phone or one of our forms (enquiry, sample request or download area), we process the data you provide \u2013 typically your name, email address, phone number, country, project details and any images or files you send \u2013 to answer your request and, if you wish, to prepare a quote and carry out your commission (Art. 6(1)(b) GDPR). Our forms are built with Forminator and stored in our website database.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To protect our forms from spam, we use Cloudflare Turnstile and Akismet (Automattic). These services check technical data such as your IP address and browser information to tell humans from bots (Art. 6(1)(f) GDPR).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For bespoke commissions, we organise design work and project steps in Trello (Atlassian, USA). We create design visualisations and client presentations in Canva (Canva Pty Ltd, Australia) and share them with you via a private link; they contain your name, images and order number, but no postal or email address. We only store the information needed for your project in these tools. Atlassian is certified under the EU-U.S. Data Privacy Framework; Canva transfers data on the basis of the EU Standard Contractual Clauses.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Our rugs are handmade by weaving partners in India and Nepal. They normally only receive the design specification. If a rug is shipped directly from the workshop to you, we pass on your name, delivery address and phone number so that it can be delivered. As there is no EU adequacy decision for India and Nepal, this transfer is based on Art. 49(1)(b) GDPR, because it is necessary for the performance of your contract.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">6. Orders in our shop and customer account<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">When you order on rugyourlife.shop (WooCommerce), we process your name, billing and delivery address, email address, phone number, order details and payment information to process your order, deliver it and handle any warranty claims (Art. 6(1)(b) GDPR), and to meet our legal obligations, for example for invoices and tax records (Art. 6(1)(c) GDPR). If you create a customer account, we store your data until you delete the account; you can do this at any time by contacting us.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you buy a gift card for someone else, we process the recipient\u2019s name and email address and your personal message in order to send the gift card (Art. 6(1)(b) GDPR).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you withdraw from a contract using our online withdrawal function, we process your name, the order details and your email address in order to handle the withdrawal and send you a confirmation of receipt (Art. 6(1)(b) and (c) GDPR).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">7. Payment providers<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Depending on the payment method you choose, your payment data is processed by Stripe Payments Europe Ltd. (Ireland), also via WooPayments (Automattic), PayPal (Europe) S.\u00e0 r.l. et Cie, S.C.A. (Luxembourg) or Klarna Bank AB (publ) (Sweden). These providers act as independent controllers and may carry out fraud prevention and, for invoice or instalment purchases, credit checks, including automated decisions. Please see their privacy policies for details. The legal basis is Art. 6(1)(b) and (f) GDPR.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">8. Shipping<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">To deliver your rug, we pass your name, delivery address and, where necessary for delivery or customs, your phone number and email address to the carrier we use for your shipment: DHL, UPS, FedEx\/TNT or a specialised freight forwarder (Art. 6(1)(b) GDPR). For deliveries outside the EU, customs authorities in the destination country receive the information required for customs clearance (Art. 6(1)(c) GDPR).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">9. Email<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Our business email for rugyourlife.com is provided as Professional Email by WordPress.com (Automattic) in cooperation with Titan; emails sent by our shop are delivered via SiteGround. Both act as our processors under data processing agreements.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">10. Analytics (only with your consent)<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">With your consent (Art. 6(1)(a) GDPR, Section 25(1) TDDDG), we use the following services to understand how our websites are used and to improve them:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n\n\n<li>Google Analytics 4, provided by Google Ireland Limited, Ireland, also via the plugins \u201cGoogle Analytics for WooCommerce\u201d and Google Tag Manager. Google Analytics 4 does not store full IP addresses. Data is automatically deleted after the retention period set in our account, at the latest after 14 months.<\/li>\n\n\n\n<li>Jetpack Stats (Automattic) on rugyourlife.com, which records page views in aggregated form.<\/li>\n\n\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Google is certified under the EU-U.S. Data Privacy Framework. Data may be transferred to the USA.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">11. Marketing and advertising (only with your consent)<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">With your consent (Art. 6(1)(a) GDPR, Section 25(1) TDDDG), we use the following tools to measure the success of our advertising and to show you relevant adverts:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n\n\n<li>Meta Pixel and Meta for WooCommerce (Meta Platforms Ireland Limited, Ireland). For the collection and transmission of the data, we and Meta are joint controllers under Art. 26 GDPR; Meta is responsible for the further processing. Our product catalogue is synchronised with Meta for adverts on Facebook and Instagram.<\/li>\n\n\n\n<li>Google Ads conversion tracking and Google Merchant Center via \u201cGoogle for WooCommerce\u201d (Google Ireland Limited, Ireland).<\/li>\n\n\n\n<li>Microsoft Advertising (Bing) Universal Event Tracking (Microsoft Ireland Operations Limited, Ireland).<\/li>\n\n\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These providers may transfer data to the USA; they are certified under the EU-U.S. Data Privacy Framework. You can withdraw your consent at any time via \u201cManage consent\u201d.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">12. Social media<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Our websites only contain simple links to our profiles on Instagram, Facebook, Pinterest and LinkedIn. No data is transmitted to these platforms unless you click on a link. When you visit our profiles, the privacy policy of the respective platform applies.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">13. Security and other technical services<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">To protect our websites against attacks, we use Wordfence (Defiant Inc., USA) and the SiteGround Security Optimizer on rugyourlife.shop. These tools process IP addresses and request data (Art. 6(1)(f) GDPR). Our websites are translated with TranslatePress; only website texts, not your personal data, are sent to the translation service DeepL.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">14. How long we keep your data<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">We delete personal data as soon as it is no longer needed for the purpose for which it was collected, unless statutory retention periods apply. Under German commercial and tax law, we keep books and annual accounts for 10 years, accounting vouchers such as invoices for 8 years and business correspondence for 6 years (Section 257 HGB, Section 147 AO). Enquiries that do not lead to an order are deleted no later than two years after our last contact.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">15. Scope<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">These terms apply to all contracts between Rug Your Life, Inh. Nayla Ventura, Poccistrasse 13, 80336 Munich, Germany (\u201cwe\u201d, \u201cus\u201d) and our customers (\u201cyou\u201d) for bespoke rugs, rugs from our art rugs shop and gift cards.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A consumer is any natural person who concludes a contract for purposes that are predominantly outside their trade, business or profession (Section 13 BGB). An entrepreneur is a natural or legal person or a partnership with legal capacity that acts in the exercise of its trade, business or profession (Section 14 BGB). The contract is concluded when we send you the order confirmation by email.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Bespoke commissions:<\/strong> After your enquiry, we send you a design proposal and an individual written quote. The contract is concluded when you accept the quote in text form (for example by email) and we confirm your order.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The contract languages are English and German. We store the contract text and send you the order details and these terms by email. You can view these terms on this page at any time; if you have a customer account, you can also view your orders there.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">3. Prices and payment<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">All prices are final prices and include the statutory VAT for deliveries within the EU. For deliveries outside the EU, import duties, taxes and customs fees may be charged by the authorities of the destination country; these are payable by you. The price of bespoke rugs is set out in our individual quote. For non-rectangular rugs, the price is calculated on the area of the smallest rectangle enclosing the rug.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bespoke commissions: a deposit of 50% of the order value is due upon order confirmation, and the remaining amount is due once the rug is finished and before it is shipped. Shop orders: you pay the full price at checkout or, where offered, a deposit; any remaining amount is due before shipment. Shipping and delivery<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">We offer free shipping on orders of \u20ac6,990 or more: within Europe (including the UK, Switzerland and Norway) for all orders, and also worldwide for orders from our art rug shop. For all other orders, the shipping costs are shown at checkout or in your quote. Transport insurance is always included.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Every rug is made to order. The production and delivery time stated on the product page or in your quote applies; it is usually between 8 and 14 weeks, depending on size, technique and design, and starts on receipt of the deposit or payment. Gift cards are sent by email immediately after payment; printed gift cards are sent by post within about one week.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If we are temporarily unable to deliver due to force majeure or other circumstances beyond our control (for example natural disasters, strikes, pandemics or transport disruptions), the delivery time is extended by the duration of the hindrance. We will inform you without delay. If the hindrance lasts longer than eight weeks, both you and we may withdraw from the contract; in that case, we will refund all payments you have made without delay.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you are a consumer, the risk of accidental loss or damage passes to you only on delivery. Cancellation of rug orders<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Our rugs are made to your specifications, so the statutory right of withdrawal does not apply to rug orders (see our <a href=\"https:\/\/rugyourlife.shop\/revocation\/\">Cancellation Policy<\/a>). However, you may cancel a confirmed rug order at any time before delivery by informing us in text form (for example by email).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In this case, we are entitled to the agreed price less the expenses we save as a result of the cancellation (Sections 648 and 650 BGB). Because design work, preparation and production involve costs from the moment the order is confirmed, we charge as follows:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Within 14 days of the order confirmation:<\/strong> 25% of the order value for design work, preparation and other costs already incurred. We refund the rest of your payment, for example the other half of your 50% deposit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>More than 14 days after the order confirmation:<\/strong> the agreed price less the expenses we save as a result of the cancellation. All costs already incurred \u2013 for design, preparation, materials, yarn dyeing, loom set-up, warping, weaving and any further production steps \u2013 are charged in full; only expenses we actually save are deducted. On request, we will provide an itemised statement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>After the rug has been finished:<\/strong> the full order value, less any shipping costs we save.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Any payments that exceed the amount due will be refunded within 14 days of your cancellation. These rules apply to all rug orders \u2013 bespoke commissions and rugs from our art rugs shop alike \u2013 regardless of whether you paid a deposit or the full price in advance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For the flat rate of 25%, you are expressly entitled to prove that we have incurred no costs or substantially lower costs; in that case, you only pay the lower amount. We point out the relevant tolerances in the product description or in your quote. For bespoke rugs, the approved design, yarn colours and dimensions form the agreed specification.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">7. Statutory warranty<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The statutory warranty rights apply. For consumers, the warranty period is two years from delivery; for entrepreneurs, it is one year. Damage caused by improper care or cleaning, moisture, direct sunlight or use outside normal residential use is not a defect. In addition, we offer our voluntary 5-Year Limited Warranty and our First-Order Guarantee, described below; they do not restrict your statutory rights.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">8. Gift cards<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Gift cards can be redeemed for rugs from our art rugs shop and for bespoke commissions. They are valid for three years from the date of purchase and cannot be exchanged for cash.
